I am still processing looking at Judge Kaplan’s trial history and seeing that before Trump, they ran point on the Chevron v Donziger case. I wasn’t exactly into politics at the time and am not sure what to make of it beyond this riveting account from reddit here and here.

First summary

Steven Donziger legally fought Chevron to try to hold them accountable for the environmental pollution they caused in Ecuador in the Amazon rainforest.

First, Chevron bribed the politicians to force Donziger to hold the trial in Ecuador. Then, when Donziger still managed to win the trial and get Chevron officially charged with fines, they then played the “corruption” card to force a retrial in the US.

Chevron accused Donziger of bribing the politicians, leading to him being investigated by the US court for corruption charges. When he refused to hand over his phone, he got charged with 6 months of federal prison for contempt of court.

In other words, a trial started by Donziger for the environmental damage caused by Chevron turned into him being put on trial and sent to prison.

Second summary mentioning Judge Kaplan

Steven Donziger won a 9.5Billion verdict against Chevron through Ecuadorian court for environmental pollution.

  • Chevron refused to pay Ecuador and removed all it’s assets.
  • Chevron files a RICO case against Steven Donziger, they select judge L. Kaplan (who has Chevron investments according to Amazon Watch).
  • Chevron moves an ex-Ecuadorian judge Guerra to the U.S. paying him $12,000 a month and his immigration fees - for this court case
  • L. Kaplan orders Steven Donziger turn over his electronics to (Chevron employees?), Steven APPEALS because this contains data on his clients from the original Ecuador Chevron court case. Violating his attorney client privilege .
    • L. Kaplan immediately charges him with contempt of court.
    • L. Kaplan assigns a PRIVATE law firm Seward & Kissel to prosocute Steven Donziger.
      • Seward & Kissel had Chevron as clients at least twice, last being 2018.
      • L. Kaplan rather than randomly assign a judge, which is for impartiality, assigns Loretta Preska to preside, overriding this standard.
  • Loretta Preska denies Steven Donziger’s request for trial by jury, sentences him to home arrest, denies his request to leave his house for 3 hours a day, Disqualifies 2 of his attorneys - explicitly assigning him an ex attorney he did not work well with.
    • He was placed under home arrest for 2 years.
    • Then Loretta Preska finds him guilty and he serves 6 additional months in prison.

Were any of you familiar with this case and have a position on what happened?

I’m not super familiar with the case, but I know it’s weird. Like SCOTUS recently declined to take up his appeal, with Gorsuch and Kavanaugh publicly dissenting:

Cert votes aren’t public, but they only need 4 votes to grant them, which means the libs did not want this case taken up as only 2 of their votes were needed (and while that can sometimes be strategic, i.e. not wanting to take a case for fear of conservatives using it to win very bad decisions, the fact they already had Gorsuch and Kav on their side here suggests that wasn’t the case). Very strange!
